01About these terms

These terms are an agreement between you and dotxyzLabs, a personally owned business (CVR 44006928, Denmark) (“we”, “us”), the maker of Votu. They apply to the Votu app and to votu.one. By creating an account or using Votu, you agree to them.

Our Privacy Policy explains how we handle your personal data.

02Votu is in beta

Votu is still being tested, for example through Apple's TestFlight. Features may change, disappear or not work as expected. We'll try hard not to lose anything you create, but we can't promise that during the beta, and we may pause or end the beta at any time.

03Who can use Votu

You must be at least 18 years old. Each account belongs to one person and has one role: audience, artist or DJ. If you want more than one role, use a separate account for each.

04Your account

• You sign in with a one-time code we email you. Keep your email secure: you're responsible for what happens on your account.
• Give accurate information and don't pretend to be someone else.
• Artists and DJs may only publish profiles and events they're entitled to represent.

05Your content

“Content” means anything you post: profile details, photos, event information, setlists, music pins, requests and votes.

• You keep ownership. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and distribute your content in Votu and when Votu content is shared, for example in links to events. We use it only to run and show Votu.
• The licence ends when you delete the content or your account, except for copies other people have already shared and anything we're legally required to keep.
• Much of your content is public. Don't post anything you don't want others to see.
• You must have the right to post what you post, including photos of other people.

06Rules: zero tolerance

On Votu you must not post, share or do anything that is:

• harassing, bullying, threatening or abusive towards anyone;
• hateful or discriminatory, including on the basis of race, ethnicity, religion, gender, sexual orientation, disability or nationality;
• sexually explicit, or nudity;
• violent, or that encourages violence or self-harm;
• harmful to minors in any way;
• illegal, or that promotes illegal activity, such as selling drugs;
• someone else's private information, or a photo of someone used without their consent;
• impersonating a person, artist, DJ or venue, or a fake or misleading event;
• spam or a scam, or an attempt to manipulate votes, requests or check-ins, for example by faking your location or using several accounts;
• infringing someone else's copyright, trademark or other rights;
• interfering with Votu: hacking, scraping, overloading it or getting around its security.

We have zero tolerance for objectionable content and abusive users. We may remove content and suspend or close accounts that break these rules, without warning when needed.

07Reporting

If you see content or behaviour that breaks these rules, email xyz (at) votu.one and tell us what it is and where it is: a username, an event or a music pin. We review every report and act on it as quickly as we can, including removing content and banning users. Reporting and blocking inside the app are coming soon.

08Events, locations and music

• Events are run by artists, DJs and venues, not by Votu. We can't guarantee that event information is right, that an event will happen, or anything about a venue.
• Follow the venue's rules and the law, including age limits.
• Song identification, check-ins and locations can be wrong.
• Artists and DJs decide what they play. Votes and requests don't guarantee anything.

09Payments

If Votu offers paid features, such as tips, Stripe processes the payment. The price and any extra terms are shown before you pay.

10Votu itself

Votu's app, design, code and brand belong to dotxyzLabs. We give you a personal, non-transferable licence to use the app for its intended purpose.

If you got Votu from Apple's App Store or TestFlight, Apple's Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple, and Apple isn't responsible for Votu or its content.

11Ending your use

You can stop using Votu and ask us to delete your account at any time. See our Privacy Policy for how. We may suspend or close your account if you break these terms or if we shut Votu down. When it's reasonable, we'll tell you first.

12Our responsibility

During the beta, Votu is provided as it is, as far as the law allows. We aren't responsible for indirect losses, for content other users post, or for events and venues.

Nothing in these terms limits liability that the law doesn't allow us to limit, including for intent or gross negligence, or takes away your rights as a consumer under mandatory law.

13Changes to these terms

We may update these terms. If a change is significant, we'll tell you in the app or by email before it applies. If you keep using Votu after that, the new terms apply.

14Law and disputes

Danish law applies to these terms. If you're a consumer, you keep the protection of the mandatory laws of the country you live in, and you can take a claim to your local courts. Please contact us first: most things can be sorted out by email.
